Terms of Service

Welcome to Gymsies. These Terms of Service ("Terms") govern your access to and use of the Gymsies mobile application (the "App") and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Gymsies. By creating an account, you represent that you meet this age requirement and have the legal authority to enter into these Terms. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service.

You may sign in using email and password, Apple Sign In, or Google Sign-In. You may delete your account at any time through the App (Settings → Delete Account).

4. User content

You retain ownership of the content you create and share through the Service ("User Content") — including messages, photos, profile information, and gym selections.

By submitting User Content, you grant Gymsies a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display that content as needed to operate the Service. This license ends when you delete the relevant content or your account, except where retention is necessary for legal, safety, or backup purposes.

You are solely responsible for the content you submit. We do not pre-screen User Content, but we may remove content that violates these Terms.

5. Blocking and reporting

The Service provides tools to block users and to report inappropriate behavior. We review reports and take action at our discretion, which may include warnings, content removal, or account suspension. We are not obligated to take any particular action in response to a report.

6. Service availability

We strive to keep Gymsies running smoothly, but we do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

7. Subscriptions and billing

Some features of the Service are available only to subscribers of Gymsies Premium. Gymsies Premium is offered as an auto-renewing subscription with the following plans (prices may vary by region; the actual price will be displayed in the App before you purchase):

New subscribers are eligible for a 7-day free trial when they start either plan. The free trial begins immediately upon subscribing.

What Gymsies Premium currently includes

As of the last updated date above, Gymsies Premium unlocks:

We may add, remove, or change Premium features over time. We will not materially reduce the features available to existing subscribers during a paid term without notice.

Auto-renewal and cancellation

Payment is charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew at the end of each period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the original subscription.

You can manage and cancel your subscription at any time by going to:

iOS Settings → [your name] → Subscriptions → Gymsies

Cancelling a subscription stops it from auto-renewing at the end of the current period. You will retain access to Gymsies Premium features for the remainder of the period you've already paid for.

Free trial terms

The free trial is available only to new subscribers. Any unused portion of the free trial period is forfeited when you purchase a subscription. If you do not cancel before the trial ends, your selected plan will begin and your Apple ID account will be charged.

Refunds

All purchases are processed by Apple. Gymsies does not handle refunds directly. To request a refund, please use Apple's refund process at reportaproblem.apple.com. Apple makes the final decision on refund requests; we cannot override or reverse their decisions.

Price changes

We may change the price of Gymsies Premium from time to time. Where required by Apple, you will be notified of price changes in advance and asked to consent before any increased price is charged. If you do not consent, your subscription will not renew at the new price.

Tax

Prices shown in the App may not include applicable taxes. Apple collects and remits any required sales tax, VAT, or similar taxes based on your billing region.

8. Third-party services

The Service integrates with third-party providers including Apple, Google, Firebase, and RevenueCat. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.

GYMSIES DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO REPRESENTATIONS ABOUT THE CONDUCT OF OTHER USERS, INCLUDING WHETHER ANY USER IS WHO THEY CLAIM TO BE.

YOUR USE OF GYMSIES — INCLUDING ANY DECISION TO MEET ANOTHER USER IN PERSON AT A GYM OR ELSEWHERE — IS AT YOUR OWN RISK. GYMSIES IS NOT RESPONSIBLE FOR INTERACTIONS BETWEEN USERS OR FOR ANY PHYSICAL INJURY, PROPERTY DAMAGE, OR OTHER HARM RESULTING FROM SUCH INTERACTIONS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GYMSIES AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID GYMSIES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gymsies and its officers, employees, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any rights of another person or entity.

12. Termination

You may stop using the Service at any time and delete your account through the App.

We may suspend or terminate your access to the Service at our discretion, including for violations of these Terms or for any reason if we believe doing so is necessary to protect the Service, our users, or others.

Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law provisions. You agree that any dispute arising from or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.

You and Gymsies agree to first attempt to resolve any disputes informally by contacting us at support@gymsies.app.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other appropriate means. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
